The Hershey Firm has been hit with a lawsuit over its Reese’s packaging.
Florida lady Cynthia Kelly filed a lawsuit in Florida’s Center District Courtroom on Dec. 28 alleging that Hershey’s Reese’s Peanut Butter Pumpkins do not replicate the product’s packaging. She is asking for $5 million in damages.
“It is a class motion towards Hershey for falsely representing a number of Reese’s Peanut Butter merchandise as containing explicitly carved-out inventive designs when there are not any such carvings within the precise merchandise,” the lawsuit states, per USA Today.
As we speak, Hershey’s was sued in a false promoting class motion.

Based on the lawsuit, the plaintiff would not have bought the products if she knew the product did not have the “cute” carvings proven on the packaging.
The lawsuit additionally calls out different Reese’s holiday-inspired shapes that do not replicate packaging together with ghosts, bats, footballs, snowmen, and extra sweets.
The lawsuit was filed on behalf of “quite a few customers [who] have been tricked and misled by the images on the Merchandise’ packaging,” per CNN.
